PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING THE TEN TOKEN PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE THE PLATFORM.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the TEN TOKEN decentralized staking platform, website (tentoken.io), and related services (collectively, the "Platform"), provided by Tokenized Economic Network ("TEN," "TEN TOKEN," "we," "us," or "our"). These Terms constitute a legally binding agreement between you and TEN TOKEN.
2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) and have the full right, power, and authority to enter into and comply with these Terms. You represent that you are not barred from using the Platform under any applicable law and that you will comply with all applicable local, state, national, and international laws and regulations.
3. Platform Description
The Platform enables users to stake TEN tokens ("Tokens") to potentially earn rewards. Features include account registration, staking mechanisms, reward calculation, withdrawal options (e.g., via Decentralized Exchanges (DEXs) or Community transfer), and participation in Referral/Level Income programs ("Business Plans"), subject to the rules outlined herein and on the Platform.
4. Account Registration and Security
You may need to create an account to access certain features. You agree to provide accurate, current, and complete information during registration and keep it updated.
You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
You are responsible for the security of the external wallet(s) you connect to the Platform. TEN TOKEN never has access to your private keys.
You agree to immediately notify TEN TOKEN at
[email protected]of any unauthorized use of your account or any other security breach. TEN TOKEN is not liable for any loss or damage arising from your failure to comply with these requirements.
5. Staking, Rewards, and Withdrawals
Staking: You may stake Tokens according to the rules and minimum requirements specified on the Platform (e.g., minimum 5000 TEN). Staking involves locking your Tokens according to the Platform's smart contracts or protocols.
Rewards: The Platform aims to provide daily rewards (e.g., 0.50%) for a specified period (e.g., 500 days), up to a maximum return multiplier (e.g., 3X). REWARDS ARE NOT GUARANTEED. They depend on various factors, including network performance, protocol rules, overall participation, market conditions, and the continued operation of the Platform and its underlying technology. Reward rates and terms are subject to change.
Withdrawals: Withdrawal options (e.g., 50% via DEX/Swap, 50% via Community) and procedures are described on the Platform. You are responsible for any transaction fees (gas fees) associated with staking or withdrawing Tokens on the relevant blockchain. Withdrawal functionality depends on the availability and operation of third-party services (like DEXs) and the underlying blockchain network.
Token Value: The value of TEN Tokens is subject to market volatility. TEN TOKEN does not guarantee the value or liquidity of TEN Tokens.
6. Business Plans (Referral and Level Income)
The Platform may offer referral bonuses (e.g., 5%) and level income based on the activity of users you refer, subject to the specific rules, requirements (e.g., minimum direct business, number of directs), and eligibility criteria outlined on the Platform.
TEN TOKEN reserves the right to modify or terminate the Business Plans at any time.
Any attempt to manipulate or defraud the Business Plans (e.g., creating fake accounts) will result in immediate suspension or termination of your account and forfeiture of any related earnings.
7. User Conduct
You agree not to use the Platform to:
Violate any applicable law or regulation.
Engage in any fraudulent, deceptive, or manipulative activity.
Infringe upon the rights of others, including intellectual property rights.
Transmit viruses, malware, or other harmful code.
Interfere with or disrupt the integrity or performance of the Platform or its underlying infrastructure.
Attempt to gain unauthorized access to the Platform or other user accounts.
Engage in any activity that could damage, disable, overburden, or impair the Platform.
8. Intellectual Property
The Platform, including its text, graphics, logos, code, and underlying technology (excluding user-provided data and public blockchain data), is the property of TEN TOKEN or its licensors and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended purposes, subject to these Terms.
9. Assumption of Risk
You acknowledge and agree that accessing and using the Platform involves significant risks, including but not limited to:
Volatility: The price of cryptocurrencies, including TEN Tokens, can be highly volatile.
Smart Contract Risk: The Platform relies on smart contracts, which may contain bugs, vulnerabilities, or errors that could result in loss of funds.
Blockchain Risk: Underlying blockchain networks may experience forks, failures, attacks, or high transaction fees.
Regulatory Uncertainty: The legal and regulatory landscape for cryptocurrencies and decentralized finance is evolving and uncertain. Changes in regulations could adversely affect the Platform or the value of Tokens.
Loss of Access: Loss of your account password or the private keys to your external wallet can result in permanent loss of access to your Tokens and rewards.
Platform Risk: The Platform could be subject to security breaches, operational failures, or discontinuation.
Third-Party Risk: Reliance on third-party services (like DEXs) carries inherent risks.
YOU ACCEPT AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ASSESSING AND BEARING ALL RISKS ASSOCIATED WITH USING THE PLATFORM.
10. Disclaimers
NO FINANCIAL ADVICE: TEN TOKEN does not provide investment, financial, legal, or tax advice. Any information provided on the Platform is for informational purposes only. You should conduct your own research (DYOR) and consult with qualified professionals before making any financial decisions.
"AS IS" BASIS: THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
NO GUARANTEES: TEN TOKEN DOES NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TEN TOKEN DOES NOT GUARANTEE ANY SPECIFIC RESULTS, INCLUDING THE EARNING OF REWARDS OR THE PRESERVATION OF TOKEN VALUE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEN TOKEN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF TEN TOKEN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TEN TOKEN'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (I) THE TOTAL AMOUNT OF FEES (IF ANY) PAID BY YOU TO TEN TOKEN IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (II) ONE HUNDRED U.S. DOLLARS ($100 USD).
12. Indemnification
You agree to defend, indemnify, and hold harmless TEN TOKEN, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Platform, (ii) your violation of these Terms, or (iii) your violation of any applicable law or the rights of any third party.
13. Termination
We reserve the right, in our sole discretion, to suspend or terminate your access to the Platform, without notice or liability, for any reason, including if you breach these Terms. You may stop using the Platform at any time. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability) shall survive.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of ADGM, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively in the courts of ADGM.
15. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Platform or by other means. Your continued use of the Platform after such notice constitutes your acceptance of the modified Terms.
16. Miscellaneous
These Terms constitute the entire agreement between you and TEN TOKEN regarding the Platform. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
